Export arrangement

8.1 If a first meaning of the Participant exports the EPAC batteries delivered to him outside the Netherlands, the Participant has the possibility, under certain conditions, to offset the Management Contribution associated with this (batch of) EPAC batteries with the Management Contribution to be paid to Stichting EPAC. These conditions are as follows:

1. a) It must concern a first impact that exports the EPAC battery.
2. b) Offsetting of the Management Contribution is only permitted at the moment that the Participant has proper documents in his administration that show the actual export.
3. c) Offsetting of the Management Contribution based on this article is only permitted to the Participant that first marketed the EPAC batteries in question in the Netherlands. The meaning as referred to in sub a of this paragraph does not entitle this right.
4. d) Offsetting of the Management Contribution based on this article must take place no later than 2 months after the end of the calendar year in which the export outside the Netherlands took place. Settlements that fall outside the set term are not permitted and will not be processed by Stichting EPAC.

 8.2 If it follows from an inspection that the Participant has made ten, in violation of the above conditions, has proceeded to settlement, Stichting EPAC will then regard this settlement as unjustified, and the deducted payment of Management Contribution will be resolved for the account of the Participant.
